1. Acceptance of Terms

By accessing or using TapTheTable ("the Service"), operated by ModuCraft, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

TapTheTable is a digital menu management platform that allows businesses to create QR code-based menus, manage orders, and engage with customers. The Service includes a web application, public menu pages, and related tools.

3. Account Registration

To use the Service, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the authority to enter into this agreement on behalf of your business.

4. Subscription Plans & Billing

  • Free plans are available with limited features as described on our pricing page.
  • Paid subscriptions are billed monthly in South African Rand (ZAR) via PayFast.
  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • We reserve the right to change pricing with 30 days notice. Existing subscriptions are honoured until renewal.
  • Refunds are handled on a case-by-case basis. Contact us within 14 days of a charge for refund requests.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that is defamatory, obscene, or infringes on intellectual property rights
  • Attempt to gain unauthorised access to other accounts or systems
  • Interfere with or disrupt the Service
  • Use automated tools to scrape or harvest data from the Service
  • Resell or redistribute the Service without written permission

6. Content Ownership

You retain ownership of all content you upload to TapTheTable (menu items, descriptions, images, branding). By uploading content, you grant us a limited licence to display and serve that content through the Service. We do not claim ownership of your content.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for downtime caused by factors beyond our control.

8. Limitation of Liability

To the maximum extent permitted by South African law, TapTheTable and ModuCraft shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account for violation of these terms. You may delete your account at any time. Upon termination, your data will be retained for 90 days and then permanently deleted.

10. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email to registered users. Continued use of the Service after changes constitutes acceptance.
